Democrats' 10 Demands to 'Rein in' ICE: A Comprehensive Reform Agenda
In the wake of the tragic shootings of Renee Good and Alex Pretti by federal agents in Minneapolis, Democrats have taken a stand, refusing to support long-term funding for the Department of Homeland Security (DHS) unless Republicans agree to a comprehensive set of reforms aimed at curbing the controversial tactics of Immigration and Customs Enforcement (ICE).
The Senate minority leader, Chuck Schumer, and his House counterpart, Hakeem Jeffries, issued a letter on Wednesday night outlining 10 formal demands to the GOP leadership. These demands are designed to prevent a funding lapse for the DHS on February 13 and to ensure the safety and rights of American citizens.
Here's a breakdown of the Democrats' proposed reforms:
Targeted Enforcement: DHS officers must obtain a judicial warrant before entering private property. Indiscriminate arrests should be halted, and warrant procedures and standards should be enhanced. Verification of non-citizenship is mandatory before detention.
Transparency and Identification: ICE and immigration agents are prohibited from wearing masks or face coverings. They must display their agency, unique ID number, and last name when conducting enforcement. Verbal confirmation of their identification is also required.
Protecting Sensitive Locations: Funds cannot be utilized for enforcement near medical facilities, schools, childcare centers, churches, polling places, courts, or other sensitive sites.
End Racial Profiling: DHS officers are barred from stopping, questioning, or searching individuals based on their presence in certain areas, job, language, accent, race, or ethnicity.
Use-of-Force Standards: A reasonable use-of-force policy must be codified, and officers should undergo expanded training and certification. Officers involved in incidents must be temporarily removed from duty until investigations are complete.
State and Local Coordination: State and local jurisdictions should retain the authority to investigate and prosecute crimes and incidents of excessive force. Evidence must be preserved and shared with relevant authorities. Large-scale operations outside targeted enforcement require state and local consent.
Systemic Safeguards: All detention facilities must adhere to basic standards, ensuring immediate access to legal counsel. States should be empowered to sue the DHS for violations. Member visits to ICE facilities should not be restricted, regardless of funding sources.
Body Cameras for Accountability: Body-worn cameras are mandatory when interacting with the public, with strict requirements for footage storage and access. Tracking or creating databases of individuals exercising their First Amendment rights is prohibited.
Civilian Enforcement Uniforms: DHS officers' uniforms and equipment should be standardized and regulated to align with civil enforcement practices.
